New York is a “no-fault” insurance state, which means that insureds are generally reimbursed by their insurance company for damages regardless of who was responsible for causing the accident. Insureds can be reimbursed for medical costs and other losses that might surface after the accident.

No-Fault will pay 80% of your salary up to a maximum of $2000 per month, and for a maximum of three years. If you were a bigger wage earner than that, or you are out of work for longer, your lawyer will have to claim the additional lost income from the at-fault driver/car owner's insurance.

No-fault insurance provides a minimum of $25,000 per person and $50,000 in total coverage for out-of-pocket medical expenses caused by an accident. This coverage, also known as “personal injury protection” (PIP) or “medical benefits” coverage, will pay only for costs that are related to the victim's injuries.

No-Fault is a personal injury coverage and does not pay for auto body repair of your car or damage to any other party's motor vehicle or other personal property.

After a crash in New York, the driver who is at fault is responsible for paying for any and all property damage caused. Unlike with personal injury claims, anyone whose car or other property was damaged can directly collect from the driver at fault, for the full amount of the damages caused.
