Exemption From Withholding If an employee qualifies, he or she can also use Form W-4 to tell you not to deduct any federal income tax from his or her wages. To qualify for this exempt status, the employee must have had no tax liability for the previous year and must expect to have no tax liability for the current year.

If you do not agree to withhold additional tax, the employee may need to make estimated tax payments. An employee is exempt from Virginia withholding if he or she meets any of the conditions listed on Form VA-4 or VA-4P. The employee must file a new certificate each year to certify the exemption.

General: An employer who pays wages to one or more employees is required to deduct and withhold state income tax from those wages. Virginia law substantially conforms to the federal definition of “wages.” Therefore, Virginia withholding is generally required on any payment for which federal withholding is required.

Who Should Be Filing Exempt on Taxes? As noted above, you can claim an exemption from federal withholdings if you expect a refund of all federal income tax withheld because you expect to have no tax liability and had no tax liability in the previous tax year.

The Virginia Form VA-4, Employee's Virginia Income Tax Withholding Exemption Certificate, must be completed so that you know how much state income tax to withhold from your new employee's wages.

By placing a “0” on line 5, you are indicating that you want the most amount of tax taken out of your pay each pay period. If you wish to claim 1 for yourself instead, then less tax is taken out of your pay each pay period.
