In 2019, the governor signed a bill that raised the legal smoking age from 18 to 21 into law. SB 21, introduced by Sen. Joan Huffman, a Republican from Houston, states that Texans must be 21 to buy, possess or use tobacco products, including e-cigarettes and other vaporizing devices.

In Texas, an individual must be at least 21 years old to legally buy or own tobacco products, including e-cigarettes or vape devices.

There are no smoking restrictions for government workplaces, private workplaces, restaurants, bars, s/gaming establishments and retail stores. Many municipalities in Texas have local 100% smoke-free laws, to include bars, restaurants, and non-hospitality workplaces.

Retailers in the United States must not sell tobacco products to anyone under the age of 21.

SALE OR PROVISION OF CIGARETTES, E-CIGARETTES, OR TOBACCO PRODUCTS TO A PERSON UNDER 21 YEARS OF AGE IS PROHIBITED BY LAW. UPON CONVICTION, A CLASS C MISDEMEANOR, INCLUDING A FINE OF UP TO $500, MAY BE IMPOSED. VIOLATIONS MAY BE REPORTED TO THE TEXAS COMPTROLLER'S OFFICE BY CALLING (insert toll-free telephone number).

It is illegal to sell tobacco products to minors (persons younger than 21). Federal rules require anyone 30 years old or younger to present valid identification before buying tobacco products. Warning signs must be posted at each retailer's location.

It is illegal to sell, give or cause to be sold or give a cigarette, e-cigarette or tobacco products to anyone under the age of 21, or to sell or give tobacco products to a person who intends to deliver it to someone who is under 21. EXCEPTION #1: For Active Duty military, the minimum-age is 18 years old.
