The Alabama Department of Environmental Management (ADEM) is the state agency charged with managing the safety and quality of Alabama's air, land, and water resources.

When the overpayments (refunds) are generated by losses from a business, for example a Schedule C, the taxpayer can expect a letter from the Department. The letter will likely contain a request for substantiation of all deductions and possibly bank statements and other information.

Any incident of contamination of groundwater that does not fall within one of the programs above, is dealt with under the authority of the Alabama Water Pollution Control Act. This statute provides the legal basis to require investigation and cleanup where groundwater has been contaminated.

It was created in 1982 with the passage of the Alabama Environmental Management Act by the Alabama Legislature. The act consolidated the various commissions, agencies, and programs that had been responsible for implementing environmental law into the Alabama Environmental Management Commission and ADEM.
