When a worker works beyond the duty hours like more than nine hours on any day or for more than forty-eight hours in any week, he must be got extra amount for overtime work, and be entitled to wages.

2023 FLSA Overtime Proposal. To begin, the DOL's proposal would raise the salary threshold level for exempt workers under the FLSA to $1,059 per week (approximately $55,000 annually) from its current rate of $684 per week ($35,568 a year).

Even if a manager works beyond their regular working hours, they are not entitled to overtime pay under the Labor Code.

The Department of Labor (DOL) has proposed an increase to the Fair Labor Standards Act's (FLSA's) annual salary-level threshold to $55,068 from $35,568 for white-collar exemptions to overtime requirements. The department also is proposing automatic increases every three years to the overtime threshold.

Section 51 and Section 59 of the Factories Act - 1948[2] states, “No employee is supposed to work for more than 48 hours in a week and 9 hours in a day. Any employee who works for more than this period is eligible for overtime remuneration prescribed as twice the amount of ordinary wages.”

The proposal would increase the threshold for these exemptions to $1,059 per week ($55,068 per year) from the current $684 per week ($35,568 per year). The proposed rule was published in the Federal Register on September 8, 2023, and is subject to a 60-day comment period that expires November 7, 2023.

Compute your overtime pay like this: determine your hourly rate, then multiply it by 1.25%. So if your base hourly rate is Php 60.00, then multiply it by 1.25% to get the overtime rate per hour, which would be Php 75.

If those numbers hold true, the salary threshold for NYC, Westchester, and Long Island would increase from $1,125 weekly (or $58,500 annually) to $1,200 weekly (or $62,400 annually) in 2024, and for the remainder of New York State, the threshold will increase from $1,064.25 weekly (or $55,341 annually) to $1,124 weekly ...
