EU Treaty Rights is term used to describe the rights of Union citizens and their family members to exercise free movement within the territory of the Member States of the EU.

EU Directive 2004/38/EC (known as the 'Citizens' Rights Directive') sets out rules that member states must follow, including how free movement applies to family members of EU citizens, and what happens to the EU citizen's residence rights if they lose their job, or become ill.

A Residence Card of a Family Member of a Union Citizen allows you to join your EU/EEA or Swiss family member if they live in Ireland. To obtain a card, your family member must use their EU Treaty Rights to sponsor an application by you. Applications may take 12 months to process.

EU Treaty Rights allow for freedom of movement within member states of the European Union. Individuals within the EEA are entitled to move to Ireland freely, along with their family members. Generally, freedom of movement is derived from a qualifying person's involvement in the economic activity of the host country.

Directives. A "directive" is a legislative act that sets out a goal that all EU countries must achieve. However, it is up to the individual countries to devise their own laws on how to reach these goals.

A legal instrument of the European Union (EU) as defined in Article 288 of the Treaty on the Functioning of the European Union (TFEU). A directive is a measure of general application that is binding as to the result to be achieved, but that leaves member states discretion as to how to achieve the result.

Ireland is a Member State of the European Union (EU) and, as such, it offers freedom of movement to nationals of the European Economic Area (EEA) and certain family members.
