Recording A quitclaim deed must be filed with the County Recorder's Office where the real estate is located. Go to your County Website to locate the office nearest you. Signing (§ 58-2205) A quitclaim deed is required to be authorized with a notary public present.

Laws Section 47-1-30. Notary Public (Section 47-1-44) In New Mexico it must be signed with a Notary Public viewing the Grantor(s) signature(s). Recording A quit claim deed is required to be filed at the County Clerk's Office where the property is located along with the required recording fee(s).

However, some counties do require that the Quitclaim Deed be signed by the Grantee in addition to the Grantor. Where does a Quitclaim Deed need to be sent after it has been recorded? Usually, a Quitclaim Deed is sent to the Grantee after it has been recorded.

You and the lender both sign the Quit Claim. The Quit Claim states that you agree to transfer the ownership of your property to the lender and the lender agrees to release you from any debt owed.

Signing - According to New Hampshire Law (§ 477:3) the Grantor must sign the quit claim deed in the presence of a Notary Public. Recording - Once notarized, the quit claim deed must be filed with the County Recorder's Office in the city or county where the property is located.

The good news is that, though it may not be an attractive option to many buyers, you can still sell the property normally. The title will still have been transferred to you. The quitclaim deed affects ownership and the name on the deed, but it does not affect the name on the mortgage.

A quitclaim deed is often used if the grantor is not sure of the status of the title (whether it contains any defects) or if the grantor wants no liability under the title covenants.

Signing a quitclaim deed and giving up all rights to the property doesn't release you from any financial obligations you may have. It only removes you from the title, not from the mortgage, and you are still responsible for making payments.
