The Privacy Act of 1974, 5 U.S.C. 552a, provides protection to individuals by ensuring that personal information collected by federal agencies is limited to that which is legally authorized and necessary and is maintained in a manner which precludes unwarranted intrusions upon individual privacy.

DD Form 2923, the Privacy Act Data Cover Sheet, is used to identify and safeguard personally identifiable information (PII) contained in hard copy documents. Its use is currently a Department of the Navy "best practice."

When mailing documents containing PII, double wrap the contents and mark the inner container/envelope with either "FOUO - Privacy Sensitive. Any misuse or unauthorized disclosure may result in both civil or criminal penalties" or attach this cover sheet.

Use of the form is considered a best practice. The Privacy Act Data Cover Sheet should be used when hand carrying PII to a recipient with an official need-to-know. It may also be used to cover documents containing PII when working at your desk.

If you provide any personal information, the Navy is bound by federal law to use the information for recruiting purposes only. Federal law further states that the United States Navy will not release any information offered by you to any person or organization outside the Department of Defense.
