The PLAINTIFF or the DEFENDANT may appeal the magistrate's decision in this case. To appeal, notice must be given in open court when the judgment is entered, or notice may be given in writing to the Clerk of Superior Court within ten (10) days after the judgment is entered.

The eviction complaint In North Carolina, the legal term for eviction is “summary ejectment.” The case starts when the landlord files a document that is called a Complaint in Summary Ejectment, which is also called an “eviction complaint.” In an eviction case, the landlord is the plaintiff.
