Earnings accumulate on a tax-deferred basis, and distributions are tax-free if made five years after the initial contribution to the plan and the employee is over 59½.

Section 457(a) of the Code permits a participant to defer compensation to a deferred compensation plan of an "eligible employer," provided that the plan satisfies the eligibility requirements of section 457.

401(k) plans and 457 plans are both tax-advantaged retirement savings plans. 401(k) plans are offered by private employers, while 457 plans are offered by state and local governments and some nonprofits.

An eligible deferred compensation plan under IRC Section 457(b) is an agreement or arrangement (which may be an individual employment agreement) under which the payment of compensation is deferred (whether by salary reduction or by nonelective employer contribution).

Below is an outline of the 2023 contribution limits for retirement plans effective January 1, 2023....2023 Contribution Limits for Retirement Plans. 401(k), 403(b), 457 Plans20222023Elective Deferral Limit$20,500$22,500Catch-up Contribution Limit (age 50 and over)$6,500$7,500Defined Contribution Plan Annual Contribution Limit$61,000$66,000

HOW ARE ROTH 457 CONTRIBUTIONS DIFFERENT FROM TRADITIONAL 457 CONTRIBUTIONS? Roth 457 contributions are made with after-tax dollars. Traditional 457 contributions are made on a before-tax basis and you pay taxes only when you take a distribution.

Therefore, annual deferrals under a ' 457(b) plan are not subject to income tax withholding at the time of the deferral. However, a participant's annual deferrals during the taxable year under a ' 457(b) plan are reported on Form W-2, Wage and Tax Statement, in the manner described in the instructions to that form.

To roll over other plan assets into PSR, you can roll over non-457 plan assets into the 401(k) Plan and still contribute through payroll deduction to the 457 Plan (there is no additional cost for maintaining a balance in both Plans).
