The harassment prevention law, commonly called Chapter 258E , is there to protect you against someone who is harassing, stalking or sexually assaulting you, no matter what your relationship with them might be. The harassment prevention law can be used to protect you against anyone.

A conviction under this law shall result in the following punishments: Imprisonment in a house of correction for not more than 2.5 years, or. By a fine of not more than $1,000, or. By both fine and imprisonment.

Does the 258E harassment prevention order go on my criminal record? A. No. Contrary to what many uninformed court employees, attorneys or even judges might otherwise tell you, a 258E (or 209A) restraining order does not appear on your criminal record.

To get a Harassment Prevention Order, file a Complaint for Protection from Harassment in any District Court, Boston Municipal Court, Juvenile Court, or Superior Court that covers the area where you live. See the the Trial Court's website for the Complaint form, Affidavit form, and Instructions.

The order will usually last for 10 business days until the return hearing. Even if the judge does not grant you a temporary ex parte order at the ex parte hearing, it's possible that you can still be given a court date for a return hearing where the abuser will be present.

A Massachusetts restraining order can be permanent. At the first hearing, it can be extended for up to one year.

All restraining orders, whether issued as abuse prevention orders or harassment prevention orders, are entered into the state's Domestic Violence Recordkeeping System, and in the Court Activity Record Information (“CARI”) for the defendant.

For the first layer, in 209A, restraining orders could be filed against relatives or those involved in current or former romantic partnerships. In 258E, orders may be filed against anyone who is considered to be a threat, whether they are known to the Plaintiff or are a stranger.
