When is personal property considered abandoned in California? In California, personal property is considered abandoned after the landlord sends out an official notice and 18 days have passed. Until that time, the property should not be handled or disposed of other than to store the property in a safe, secure location.

It gives the tenant a specific deadline to reclaim their personal property and to pay for any applicable and reasonable storage fees for the property. It also clearly notifies the tenant that, if they do not reclaim their property, that it may be kept, sold, or destroyed.

Generally, if the property in question has not had any activity within a certain period of time, e.g., three years for most properties, and the holder is unable to locate the property owner, it is considered abandoned and must be reported to the Unclaimed Property Division of the State Treasurer's Office.

Abandoned property refers to any personal property that is left by an owner who has intentionally relinquished all rights to its control. When property is intentionally abandoned, it belongs to no one until it is found.

If your tenant anticipates an extended absence of more than seven consecutive days they are required to notify you of their absence. In order to determine that a unit is abandoned the landlord must look for evidence of abandonment. Evidence of abandonment may be one of the following: the return of keys.

You must contact the landlord during the 5 or 8 day period and you must pick up your things no longer than 15 days after that or your landlord will dispose of them. ORS 90.425. Take everything with you when you leave if you can. If you cannot, at least box your things to avoid breakage and loss.

The property has been continuously unoccupied for the preceding year. The property is not fit for human habitation and is a blight on the surrounding area. The organization interested in the property sends a 30-day notice of intent to any relevant party that might have legal title or interest in the property.
