The Hazardous Materials Business Plan Program was established in 1986. Its purpose is to prevent or minimize damage to public health, safety, and the environment, from a release or threatened release of hazardous materials. It also satisfies community right-to-know laws.

The HMT is located in 49 CFR, Section 172.101. It contains more than 3,000 proper shipping names of substances most commonly shipped or carried as hazardous materials.

To identify if a substance is hazardous, check the product's container label and/or the SDS which is available from the supplier. If a product is not classified as a hazardous chemical under the Work Health and Safety Act 2011, a SDS is not required and therefore may not be available.

Hazardous wastes may be accumulated for no more than 180 days, unless the waste must be transported 200 miles or more: then the time limit is 270 days [40 CFR 262.16(b)]. Small Quantity Generators of hazardous waste may never accumulate more than 6,000 kg of hazardous waste onsite at any time.

A Hazardous Materials Business Plan (HMBP) contains basic information on the location, type, quantity, and health risks of hazardous materials stored, used, or disposed of by businesses operating in the state.

Each container needs to be labeled with the words HAZARDOUS WASTE , as well as the Accumulation Date (the date the waste was generated). Because this date allows regulatory agencies to verify you aren't storing waste longer than you're allowed, not including it leaves you subject to violations.

While that waste is onsite, the Environmental Protection Agency (EPA) requires weekly inspections. Inspection records also must o be kept to verify compliance. The purpose of weekly inspections is to make sure that each container is in good condition (free from rust, dents, cracks or any other signs of corrosion).
