If the tenant decides they do not want to renew the lease at the end of the term, they have the right to move out. It is generally accepted that tenants must give the landlord at least 30 days' notice prior to the date of lease termination.

This Notice must be given to the Landlord not less than 3 months before the date on which the tenant wishes the tenancy to end. Serving this Notice means that the lease will not continue beyond the date specified in the notice (as it would otherwise do under the Landlord and Tenant Act 1954).

Your name, and the landlord's name and address. The date you're writing the letter. Informing the landlord you're breaking your lease early. The reason why you're breaking your lease. The building and apartment you're vacating. The date by which you're vacating.

Fixed-term: If you have a fixed-term tenancy, like a one year lease, then you must give notice at least 60 days before the end of the lease. The termination date cannot be before the last day of the fixed term. If you don't give notice, the tenancy continues.

A landlord can end a tenancy only for the reasons allowed by the Act. In most cases, the first step is for the landlord to give the tenant a notice in writing that they want the tenant to move out. The proper forms a landlord must use for giving a notice to end the tenancy are available from the Board.

This is called a Section 26 Request. You must give at least 6 and no more than 12 months notice of your desire for a new tenancy. The earliest you can serve a Section 26 request is therefore 12 months before the expiry date stated in your Lease.

The date that the tenant warning letter was written. The name and the basic personal information of the tenant. The name of the landlord or the owner of the property. The reason why a tenant warning letter has been written. The incident or situation that the tenant is involved in.

1. Month-to-month tenancy: you must give at least 60 days notice from the end of a rental period. ... If you do not give a notice to terminate your tenancy, your tenancy automatically renews and you can stay in the unit as a month-to-month tenant.

In California, for example, you're entitled 30 or 60 days notification that he's not going to renew. If you break the lease or don't pay the rent, you still get three days' notice and a chance to fix the problem. When your notification expires, the landlord has to go to court to evict you if you refuse to leave.

If a Landlord would like the Tenant to leave at the end of the term or they wish to grant a new Lease on new terms, then a Section 25 notice must be served within 6 to 12 months before the Landlord wants the tenancy to end.
