Basic disclosure It includes information on any 'unspent' convictions you have. Under the Rehabilitation of Offenders Act 1974, some criminal convictions can be treated as 'spent' after a certain length of time. Spent convictions are not included on a basic disclosure.

15 years, if you were 18 or over on the date of the conviction. 7 years and 6 months, if you were under 18 on the date of the conviction.

If the person was 18 years of age or older at the time of the offense (i.e. legally considered to be an adult), then the conviction will be expunged from their record 11 years after the conviction date (not the offense date).

Standard DBS check This is a check of your criminal record which will show details of all spent and unspent convictions, cautions, reprimands and final warnings held on central police records (apart from protected convictions and cautions).

If you're still in your rehabilitation period following a criminal conviction, your conviction is unspent. Any custodial sentence over two and a half years stays unspent. If you were found guilty of a criminal offence by a court, following the specified time-period, your conviction will be considered “spent”.

you do not have to declare spent convictions, unless you are applying for an exempt occupation such as a doctor or social worker. you will have to declare unspent convictions.

The US Embassy advises that they expect you to declare any arrests or convictions, regardless of the nature of the offence or the length of time that has elapsed. Note that the Rehabilitation of Offenders Act 1974 does not apply to US visa law, so even convictions which may be deemed as spent would need to be declared.

a standard check contains details of all spent and unspent convictions, informed warnings, cautions and diversionary youth conferences. an enhanced check contains the same information as a standard check and police records held locally.
