Assembly Bill 469 (Chapter 655, Statutes of 2011), also known as the Wage Theft Protection Act of 2011, went into effect on January 1, 2012, and adds section 2810.5 to the Labor Code. The act requires that all employers provide each employee with a written notice containing specified information at the time of hire.

LC 2810.5 requires employers to give their new, non-exempt hires written notice of their regular rate of pay and other important information.

DLSE Form 1 allows employees to make a claim for wages and penalties concerning any violation of California wage and hour laws that fall within the Labor Commissioner's jurisdiction, including: Unpaid wages,⁠30. Unpaid commissions,⁠31. Unpaid vacation wages,⁠32.

DLSE Form 55 for claimants who worked irregular hours and are claiming unpaid wages (for non-overtime or overtime hours worked) or meal and rest period violations: DLSE-55 (Rev. 10/03). See Sample DLSE-55.

What are the penalties for not complying? Civil penalties of one hundred dollars ($100) for each aggrieved employee per pay period for the initial violation and two hundred dollars ($200) for each aggrieved employee per pay period for each subsequent violation may be incurred.
