Discovery in civil cases (like a California personal injury case) is a process where both sides, plaintiff (person hurt), and the defendant (person defending the injury claim), can obtain information from each other to help not only build a case or defense, but also to prepare evidence for a jury trial, if necessary.

Discovery in a California Limited Case One deposition is allowed. A defense medical examination is allowed. Expert witness discovery in the form of an exchange is allowed. The court can issue an order allowing a party to conduct additional discovery.

Timeframe for discovery If you are the plaintiff, you can begin discovery 10 days after you serve the first papers in the case or anytime after the defendant files a response. If you are the defendant, you may begin discovery as soon as the case is filed.

Discovery may be obtained of the identity and location of persons having knowledge of any discoverable matter, as well as of the existence, description, nature, custody, condition, and location of any document, electronically stored information, tangible thing, or land or other property.

The distinction seems simple enough. If your case is valued at more than $25,000, then you should check the Unlimited box. If your case is valued at less than $25,000, then you should check the Limited box.

You may use Notice of Appeal/Cross-Appeal (Limited Civil Case) (form APP-102) to prepare a notice of appeal in a limited civil case. You can get form APP-102 at any courthouse or county law library or online at .courts.ca.gov/forms.

The Unlimited Civil case-type category includes all tort cases with potential damages in excess of $25,000 and civil complaints other than torts with claims in excess of $25,000—e.g., contracts, real property, and employment cases—or with a request for some form of equitable relief.
