The Baker Act. The Baker Act was enacted by the Florida Legislature in 1972 to provide legal procedures for mental health examination and treatment. The Act prohibits the indiscriminate admission of persons to state institutions or the retention of persons without just cause.

What is a Baker Act Proceeding? Florida's Baker Act law is a means of providing individuals with emergency services and temporary detention for up to 72 hours for mental health examination pursuant to Florida Statute Chapter 394.
