Statute of Limitations An unlawful detainer action can be filed at any time while the defendant is in actual possession of the property. However, a Three-Day Notice to Pay Rent or Quit must be served within one year after the rent is due.

Eviction Cases are governed by Rules 500 – 507, and Rules 510.1 0 510.13, Texas Rules of Practice in Justice Courts. Eviction Cases must be filed in the Justice Court in the Justice of the Peace Precinct in the county in which the real property is located. See Section 24.004, Texas Property Code.

(a) A person commits a forcible entry and detainer if the person enters the real property of another without legal authority or by force and refuses to surrender possession on demand.

How the eviction process works The landlord gives the tenant a written Notice to do something by a deadline. For example, a Notice might say to fix a problem or move out by a certain date. ... In order to properly plead forcible detainer, the landlord must allege: that the landlord was in actual possession of the apartment at the time of entry; that a forcible entry has occurred (i.e., the landlord did not consent to the tenant's possession).

Unlike unlawful detainers, which are perfectly legal and proper when a tenant needs to be removed from a rental unit, a forcible entry and forcible detainer is against the law. An example of a forcible entry or forcible detainer is when the landlord resorts to “self-help” remedies to remove a tenant.

Pay a filing fee You'll need to pay a fee of $240-$450 to the clerk when you file your forms. If you can't afford the fee, you can ask for a fee waiver. Each tenant named in the Answer needs to pay a filing fee or ask for a fee waiver.
