Your landlord can evict you from your home if they have legal reason to do so. What constitutes legal reason is set out by the Residential Tenancies Act of Ontario. You can be evicted for breaking the landlord/tenant agreement and not doing what is expected or for unacceptable behaviour.

Harassment. Under the Residential Tenancies Act, 2006 it is an offence: for a landlord (or someone acting on behalf of a landlord) to do things that would interfere with a tenant's ability to enjoy living in their rental unit. to threaten, interfere with, or harass a tenant to move out of a rental unit.

The landlord must take the following steps to carry out a legitimate eviction: Provide a notice terminating the tenancy giving the reasons; Apply to the Landlord and Tenant Board for an order to evict a tenant; and. Present evidence at the hearing as to why a tenant is being evicted.

Section 48(1) of the RTA permits the landlord to give notice of termination to a tenant if the landlord, in good faith, requires the unit for residential occupation for a period of at least one year by the landlord, a specified family member or a caregiver. This notice is often referred to as a "N12 notice".

How Long Does It Take to Evict a Tenant in Ontario? Unfortunately, eviction is not a speedy process. It can take anywhere from 85 – 138 days to evict a tenant after an eviction notice has been given. If the tenant needs to be removed by the Sheriff's office, the timeline could stretch to 168 days.

To give notice, you must use the Tenant's Notice to Terminate the Tenancy (Form N9). This form is available in the Forms section at tribunalsontario.ca/ltb or from any LTB office.
