A writ of prohibition is issued by a Court to prohibit the lower courts, tribunals and other quasi-judicial authorities from doing something beyond their authority. It is issued to direct inactivity and thus differs from mandamus which directs activity.

One example where the Supreme Court granted a petition for writ of certiorari and heard a case was entitled Filarsky v. Delia. In this case, the Supreme Court had to determine whether qualified immunity extends to a lawyer who is working for the government but is not a government employee.

A writ of prohibition is distinct from: A writ of certiorari which is an ancillary remedy issued for an act already done such as to quash a decision. A writ of mandamus which compels the performance of a public duty.

One example of an appropriately granted writ of prohibition can be seen from the New York Court of Appeals case Soares v. Herrick, 981 N.E. 2d 260 (N.Y. 2012), in which the judge of a county court, in excess of his discretion, disqualified the district attorney from prosecuting a criminal case.

The writ of certiorari has been used by the Supreme Court and the High Courts to quash the orders passed by the lower courts when they have overstepped their jurisdiction, violated the principles of natural justice, or have made an error of law. The courts have clarified the requirements in a plethora of judgments.
