In Colorado, all employers with 50 or more full-time employees are required to offer some form of health insurance benefit. Once you have 50 employees, you are considered a large employer. This means that you may face penalties if you do not offer health insurance.

This Colorado network access plan is for Aetna® health maintenance organization (HMO) plans (Net ID 2089). The Colorado Division of Insurance has licensed Aetna Health Inc. (Aetna) as an HMO. The Aetna HMO Colorado network offers health plans in 15 counties.

To be clear, the Affordable Care Act (ACA), does not require employers to provide health insurance for their employees. However, there can be penalties for businesses with 50 or more full-time or full-time-equivalent employees who don't offer affordable health insurance coverage to employees.

No small employer, generally those with fewer than 50 full-time and full-time equivalent employees, is subject to the Employer Shared Responsibility Payment, regardless of whether they offer health insurance to their employees.

For those that previously received their Form 1095-B in the mail, you can receive a copy of your Form 1095-B by going out to the Aetna Member Website in the “Message Center” under the “Letters and Communications” tab or by sending us a request at Aetna PO BOX 981206, El Paso, TX 79998-1206.

Under Colorado law, employees are entitled to certain leaves or time off, including paid family and medical leave, family care leave, paid sick leave, domestic violence leave, Civil Air Patrol leave, qualified volunteers leave and voting leave.

Starting with the 2019 tax year, there is no requirement for individuals to have a Qualified Health Plan or pay a penalty for not having a plan.
