The Transfer Disclosure Statement ( Form TDS) asks the seller to disclose any environmental hazards, including mold, on page 2 under question C. 1.

Mold growth itself is not a code violation. However, the presence of mold is sometimes related to building problems that are code violations.

While a seller's property disclosure form is not required under Florida law, Florida law does require seller's and their realtors to disclose any significant property defects that may not be easily visible to the buyer. Buyers still have the responsibility to have the property inspected.

Florida Statute 83.56 states a tenant should write to the rental unit owner or property manager outlining that you need the mold problem fixed (or other problems with the unit), and that if it is not fixed within 7 days, then you intend to terminate the rental agreement and move out.

Florida doesn't have any statutes or regulations that require landlords to disclose high concentrations of mold in rental properties to prospective tenants or buyers. Also, while federal law requires disclosures about lead paint, it doesn't impose a similar duty on landlords when it comes to mold.

Fortunately, no state or federal laws prohibit homeowners from selling mold-infested properties. However, you should disclose to potential buyers or lenders.

2. Landlord Liability for Mold. Currently, there is no federal law covering landlords' responsibilities for mold. And the State of Florida doesn't have any laws that address duties or liability when it comes to prevention and remediation.

Florida law requires sellers to disclose any issues they know about that materially affect the value of a home or property. This requirement applies even if the buyer does not ask whether the seller knows about defects.
