A break notice in a commercial lease is a notice which either or sometimes both a landlord or tenant can serve on the other to terminate the lease before the contractual expiry date under the lease. There needs to be a contractual right in the lease to terminate it before the expiry date.

In England, landlords must give their tenants at least 2 months' legal notice of eviction. Most private renters have assured shorthold tenancies. This type of tenancy entitles tenants to a legal notice in writing even if they don't have a written tenancy agreement.

In fact, once a break notice has been validly served it cannot be withdrawn; service of the notice effectively terminates the existing lease and creates a new tenancy by implication if the tenant remains in occupation past the break date (Tayleur v Wildin (1867-68) LR 3 Ex 303).

A break clause is a tenancy agreement clause that allows either the tenant or landlord, to end the tenancy agreement during the fixed term. For example, a 12-month tenancy agreement with a six-month break clause would allow either party to end the tenancy in ance with that clause.

Exercising a break clause will allow you to terminate a lease before the expiry of the contractual term. However, in order to exercise a break right effectively, the break notice must be served in compliance with the lease terms and any conditions to the break must be complied with.

The lease will provide details of how the break notice must be sent to ensure effective service i.e. there may be a requirement to send the notice by registered post or by personal service.

Your landlord only needs to give 'reasonable notice' to quit. Usually this means the length of the rental payment period – so if you pay rent monthly, you'll get one month's notice. The notice does not have to be in writing.
