The 13th Amendment formally abolished slavery. The loophole in this amendment is that slavery as a punishment for crime is still allowed.

Indentured servitude differed from slavery in that it was a form of debt bondage, meaning it was an agreed upon term of unpaid labor that usually paid off the costs of the servant's immigration to America. Indentured servants were not paid wages but they were generally housed, clothed, and fed.

Designed to help enforce the Thirteenth Amendment, the Act declares that holding any person to service or labor under the peonage system is unlawful and forever prohibited. It defines peonage as the "voluntary or involuntary service or labor of any persons . . . in liquidation of any debt or obligation."

Mississippi was one of four states that rejected ratification of the 13th amendment, along with New Jersey, Delaware, and Kentucky. The amendment passed without Mississippi's support anyway, and all the other no-voting states symbolically ratified the amendment in the following years.

Peonage, also called debt slavery or debt servitude, is a system where an employer compels a worker to pay off a debt with work. Legally, peonage was outlawed by Congress in 1867.

Thirteenth Amendment, Section 1: Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.

The Emancipation Proclamation described enslaved people as "all persons held as slaves" and tells them to abstain from all violence (except in self-defense) and to labor for reasonable wages. The 13th Amendment describes ending "slavery or involuntary servitude, except as punishment for a crime."

Involuntary servitude or involuntary slavery is a legal and constitutional term for a person laboring against that person's will to benefit another, under some form of coercion, to which it may constitute slavery.
