(a) An owner may record a notice of cessation if there has been a continuous cessation of labor on a work of improvement for at least 30 days prior to the recordation that continues through the date of the recordation. (b) The notice shall be signed and verified by the owner.

Section 8180 - When completion occurs (a) For the purpose of this title, completion of a work of improvement occurs upon the occurrence of any of the following events: (1) Actual completion of the work of improvement. (2) Occupation or use by the owner accompanied by cessation of labor.

Section 8050 - Work of improvement (a) "Work of improvement" includes, but is not limited to: (1) Construction, alteration, repair, demolition, or removal, in whole or in part, of, or addition to, a building, wharf, bridge, ditch, flume, aqueduct, well, tunnel, fence, machinery, railroad, or road.

Civil Code Section 1988 provides: (a) If the personal property described in the notice is not released pursuant to Section 1987, it shall be sold at public sale by competitive bidding.

Code § 8034(b)): Neither laborers, nor anyone who has a direct contractual relationship with the direct (prime) contractor (i.e., 1st tier subcontractor or supplier), has to give the notice (Civ. Code § 9300(b)(2)). Anyone else who provided labor, service, equipment or materials for the work (Civ.

For public works projects, Civil Code section 9200 provides that “completion of a work of improvement occurs at the earliest of the following times”: Acceptance of the work of improvement by the public entity; or. Cessation of labor on the work of improvement for a continuous period of 60 days.

8190. (a) An owner that records a notice of completion or cessation shall, within 10 days of the date the notice of completion or cessation is filed for record, give a copy of the notice to all of the following persons: (1) A direct contractor. (2) A claimant that has given the owner preliminary notice.

The notice of the sale shall not be published before the last of the dates specified for taking possession of the property in any notice given pursuant to Section 1983. The notice of the sale shall describe the property to be sold in a manner reasonably adequate to permit the owner of the property to identify it.
