An employer who desires to apply for a labor certification, for occupations other than sports, on behalf of an alien must file Form ETA 9089.

Once the application is filed, it will be processed by the Department of Labor. Typically, this will take around three months.

PERM Application Process To obtain a permanent labor certification, employers must file Form 9089 (officially called the “Application for Permanent Employment Certification”). The PERM application may be filed in several different ways, depending on the circumstances.

An employer who desires to apply for a labor certification, for occupations other than sports, on behalf of an alien must file Form ETA 9089.

ETA 9089 is the form distributed by the United States Government Department of Labor so foreign employees can get permanent work approval.

Form - 9089 - After filing the form, DOL is taking more than 255 days to adjudicate the PERM. The three possible outcomes are - PERM approval; PERM denial; PERM audit. If DOL requests an audit then the employer has to provide additional evidence and this might cause further delay.
