If you're a bona fide resident of Puerto Rico, you'll be able to exclude income from Puerto Rican sources on your U.S. income tax return. However, this exclusion from U.S. income taxation doesn't apply to amounts you receive for services performed as an employee of the United States or any agency thereof.

US Taxation of Rental Income Generally As a general rule, a non-US person who rents out his or her US home is subject to a 30% withholding tax imposed on the gross amount of each rental payment.

In the case of Puerto Rican non-resident foreign nationals, investment income, such as rent and interest income, is subject to a flat rate of 29%, and dividends to a flat rate of 15% (or a lower flat rate in certain cases).

In 2019, Act 60 consolidated two tax havens, Act 22, which applies to individual investors, and Act 20, used for export services companies. The provision provides these new residents of Puerto Rico with a 100% federal tax exemption from Puerto Rico-sourced income, interest, dividend and capital gains income.

(1) An individual (whether a United States citizen or an alien), who is a bona fide resident of Puerto Rico during the entire taxable year, will exclude from gross income the income derived from sources within Puerto Rico, except amounts received for services performed as an employee of the United States or any agency ...

Income derived from residential rental activities in Puerto Rico is exempt from income tax until 2025, regardless of whether such activities are conducted through an individual or a legal entity like an LLC. Therefore, operating through an LLC does not inherently make this income taxable.

Generally, if you are a Puerto Rico bona fide resident, you must file a Puerto Rico tax return. If you are not a bona fide resident of Puerto Rico, you must file both a Puerto Rico tax return and a U.S. tax return.

A Puerto Rico LLC taxed as a Corporation of Individuals is taxed as a pass-through entity and doesn't pay corporate income tax, making it similar to a partnership. However, unlike a partnership, a corporation of individuals can make distributions to its members that aren't subject to US self-employment taxes.
