Used oil can be re-refined into lubricants, processed into fuel oils, and used as raw materials for the refining and petrochemical industries. Additionally, used oil filters contain reusable scrap metal, which steel producers can reuse as scrap feed.

In California, used oil must be managed as a hazardous waste. The Department of Toxic Substances Control (DTSC) adopted regulations specific to used oil to maximize the collection and recycling of used oil and protect human health and the environment.

Hazardous wastes are any used or discarded materials or manufacturing by-products in any form (liquid, solid, sludge, gaseous) that exhibit the characteristics of hazardous wastes. The four characteristics of hazardous waste are Ignitability, Reactivity, Corrosivity, and Toxicity.

General Public: You can take your oil to a certified collection center (CCC). Many communities have curbside recycling programs that allow you to leave your oil at the curb (properly packaged). Or you can have your oil changed by a service station that recycles the oil for you.

Used oil is generally not considered a hazardous waste, per the EPA if it is not contaminated with hazardous chemicals.

While used oil is regulated under Title 40 of the Code of Federal Regulations (CFR) part 279, it is not a listed hazardous waste at the federal level. Some individual states—including California and Florida—classify used oil as a hazardous waste. The state of Ohio, in contrast, classifies used oil as special waste.

This law requires oil manufacturers to pay to CalRecycle $0.26/gallon through December 31, 2013, of lubricating oil sold in California. On and after January 1, 2014, the fee decreases to $0.24/gallon.
