Investigated reports of child abuse are forwarded to the CACI. These reports contain information related to substantiated cases of physical abuse, sexual abuse, mental/emotional abuse, and/or severe neglect of a child.

Generally, the initial investigation lasts 45 days. If the investigation extends beyond this period, the agency must notify the family, and document their justification for an extension past the initial 45 day period. At the conclusion of the investigation CPS will notify the parents in writing of their decision.

INCONCLUSIVE – Defined by Penal Code section 11165.12(c) to mean circumstances where child abuse or neglect are determined not to be unfounded, as defined, but the findings are inconclusive and there is insufficient evidence to determine whether child abuse or neglect, as defined, has occurred.

Types of emotional abuse threatening, shouting at a child or calling them names. making the child the subject of jokes, or using sarcasm to hurt a child. blaming and scapegoating. making a child perform degrading acts.

CPS investigations can take up to 30 days to complete, during which they will conduct interviews, observe the home environment, and possibly do other forms of investigation such as medical examinations or psychological evaluations.

If the allegation is substantiated, the county will refer information regarding the caregiver along with case information to the Child Abuse Central Index (CACI) of the California Department of Justice for inclusion in the statewide database.

A finding of substantiated means DHS, after an investigation of a report of child abuse or neglect and based upon some credible evidence, determined that child abuse or neglect occurred.

Signs of emotional abuse include: Lack of confidence and self-esteem. Difficulties controlling emotions. Extreme behaviour, like becoming overly demanding, aggressive, having outbursts, or becoming passive.

A mandated reporter must complete and submit form BCIA 8572 even if some of the requested information is not known. (PC section 11167(a).) Mandated child abuse reporters include all those individuals and entities listed in PC section 11165.7.
