In order to appeal a decision of the Pennsylvania Department of Revenue, Board of Appeals, a petition must be filed with BF&R. Petitions may be filed via mail, electronically, fax or hand-delivery. While a specific appeal form is not required, BF&R prefers appeals to be filed using the Petition Form.

Once the appeal is fully briefed and argued, the court still needs time to decide the case and write an opinion. In Pennsylvania, the current rule of thumb is that it takes about a year for an appeal to proceed from the filing of a notice of appeal to the entry of a final order.

You may file the document at the courthouse, but it is not necessary to do so. In Pennsylvania, most Powers of Attorney must contain specific language, such as a notice to the principal, in order to be valid.

You can get the form from the Prothonotary (the clerk of the civil part of the Common Pleas Court). Appendix A shows a Notice of Appeal. Once you have filled out the Notice of Appeal, you must file it with the Prothonotary in the Common Pleas Court where the office of the District Justice is located.
