If your employer failed to pay you all of the wages you earned, you can either file a wage complaint with the Colorado Department of Labor and Employment (CDLE) or file a lawsuit in court. (Colorado has posted its wage claim form—called a Request for Mediation: Wage and Labor Law Complaint Form—online.)

The Colorado Wage Act (C.R.S. 8-4-101 et seq.) requires Colorado employers to pay employees their earned wages in a timely manner. The Wage Act is commonly referred to as the Colorado Wage Law, the Colorado Wage Claim Act, or the Colorado Wage Protection Act.

If an employer fails to pay all earned wages, the employee may make a written demand for payment. After receiving the written demand, the employer has 14 days to pay the full amount owed to the employee.

This INFO #9 covers employee and employer rights and responsibilities related to the “Transparency in Pay and Opportunities for Promotion and Advancement,” Part 2 of the Equal Pay for Equal Work Act (“the Act”) (C.R.S. § 8-5-101 et seq. ) , and Equal Pay Transparency Rules (“EPT Rules”) (7 CCR 1103-13) .

If an employer provides paid vacation for an employee, the employer shall pay upon separation from employment all vacation pay earned and determinable in ance with the terms of any agreement between the employer and the employee.

If an employee is covered by federal and Colorado state minimum wage laws, then the employer must pay the higher minimum wage. Federal minimum wage is currently $7.25 per hour, which is lower than the 2023 Colorado state minimum wage of $13.65.
