To record a mining claim, the claimant must file a copy of the location notice of the claim in the recorders office in the county which the claim lies and with the BLM State Office in Sacramento within 90 days of the location of the claim. The mining claim must be on Federally administered land open to mineral entry.

Assessment work includes, but is not limited to, drilling, excavations, driving shafts and tunnels, sampling (geochemical or bulk), road construction on or for the benefit of the mining claim; and geological, geochemical, and geophysical surveys.

Once a mineral deposit has been discovered, land ownership has been verified, and it has been determined that the land is not already claimed, a prospector can stake a claim. When staking a claim on federal lands, location posts or rock monuments are placed at each corner of the claim.

If your claim is located on BLM land, you must consult with the BLM Geologist in the appropriate BLM office which manages the public land. The BLM will then set forth the requirements and make a determination of your request. Before occupancy you need to receive approval from the BLM.

With an approved BLM Plan of Operation, a building can be built on the land: any building that benefits and improves the claim, though you cannot permanently live on a mining claim. As stated by the BLM, this can be the "construction of a building, road, fence, or enclosure necessary for mining."

Recreational camping is usually allowed on public lands, so if the land where your claim or site is located is open to camping, you can camp there up to 14 days.

Lode claims cover classic veins or lodes having well-defined boundaries and also include other rock in-place bearing valuable mineral deposits.
