State Court Arbitral Award Confirmation The procedure for confirming an arbitration award is relatively straightforward and is necessary because an award cannot be enforced within the United States until an appropriate federal or state court confirms the award.

While winning an arbitration award may not immediately end the dispute, particularly where the unsuccessful party refuses to voluntarily comply with the award or seeks to vacate, modify or correct the award, streamlined rules are in place to enforce awards in federal and state courts.

This Petition (Confirm Arbitration Award) (NY) is a standard form that attorneys can use to commence a special proceeding in New York Supreme Court to confirm an arbitration award under Article 75 of New York's Civil Practice Law and Rules (C.P.L.R.).

The arbitrator will write the award and the AAA® will send that to the parties once it is ready. Depending on the rules and the parties' arbitration agreement, the date the award must be given to the parties may differ, but it is usually between 14 and 30 days from the close of hearings.

Instead, if a party wins in the arbitration and the other party does not do what the award says, the winning party may go to court to “confirm” the arbitration award. Under AAA rules, parties to AAA cases agree that the arbitration award can be entered as a judgment in any federal or state court with jurisdiction.

Any party to an arbitration in which an award has been made may petition the court to confirm, correct or vacate the award. The petition shall name as respondents all parties to the arbitration and may name as respondents any other persons bound by the arbitration award.

If there is no action already pending between the parties, you may confirm an arbitration award by commencing a special proceeding in the proper court and county the arbitration agreement specifies. For special proceedings, you should style the parties as petitioner and respondent, instead of plaintiff and defendant.
