A preservation letter, also known as a preservation demand or preservation notice, is written communication sent by a would-be plaintiff's legal team to the defendant requesting that any evidence he or she may have that is pertinent to the case be preserved.

If evidence is not properly preserved prior to collection, it may be contaminated or destroyed. If evidence is not properly preserved and stored prior to forensic analysis or testing, it may deteriorate, destroying or devaluing it as a source of information.

The government has a duty to preserve certain types of evidence it collects during criminal investigations and prosecutions. This duty exists in order to protect a defendant's rights to due process and a fair trial under the Sixth and Fourteenth Amendments to the U.S. Constitution.

A violation of a duty to preserve evidence may result in a Court order of evidence preservation or give an adverse jury instruction where evidence has been destroyed. See, e.g., Judicial Council of California Civil Jury Instruction 204.

The retention of all items of physical evidence secured in connection with a felony for the period of time that any person remains incarcerated, on probation or parole, involved in civil litigation in connection with the case, or subject to registration as a sex offender.
