Another situation where a waiver may be invalid is if a separate party, not protected by the legal document, caused your injuries.

To be valid and enforceable, liability waivers in Florida must contain language that is clearly written, unequivocal, unambiguous and specific on the risks and rights being waived by the signee.

The three essential elements of a valid waiver are: (a) existence of a right; (b) the knowledge of the existence thereof; and, (c) an intention to relinquish such right.

However, as a general rule, departments should retain signed waivers for five (5) years after the event, or, if a participant is under the age of eighteen (18), five (5) years after they reach the age of 18.

The department sponsoring the activity must keep releases for at least three years after the activity ends. Releases signed by a parent or guardian on behalf of a minor must be retained for at least three years after the activity ends or until the minor reaches the age of 20, whichever date is later.

The UC Waiver of Liability is designed to protect the University and its employees from legal liability for injuries that may occur to students or other individuals who participate in certain UC-sponsored activities on and off campus.
