A Favor of the Faith Case is also known as the “Petrine Privilege” because it allows the pope, as the Successor to St. Peter, to dissolve a marriage in a situation in which only one party in a valid marriage is unbaptized.

Unlike with divorce, if a marriage has been legally annulled, neither “spouse” is eligible for permanent alimony or equitable distribution of property. In contrast, a religious annulment will not have any legal impact whatsoever on your life or relationship.

By the Privilege, the Holy Father dissolves a presumably valid and binding natural marriage for the good of the faith of the Catholic party (either the Petitioner or current/intended spouse).

The diocesan Tribunal reviews each case for final determination. The Pauline Privilege does not apply when a Christian has married a non-Christian. In those cases, a natural marriage exists and can be dissolved for a just cause, but by what is called the Petrine Privilege rather than by the Pauline Privilege.

However, a natural marriage, even if consummated, can be dissolved by the Church when to do so favours the maintenance of the faith on the part of a Christian, cases of what has been called Pauline privilege and Petrine privilege.
