Under the provisions of Section 784.046 of the Florida Statutes, repeat violence means two incidents of violence or stalking one of which must have been within 6 months of filing a petition and must have been directed against the petitioner or the petitioner's immediate family member.

When should this form be used? If you are a victim of stalking, you can use this form to ask the court for a protective order prohibiting stalking. Stalking means the repeated following, harassment, or cyberstalking of one person by another.

An injunction is a court order against another person who has been physically violent with you and/or has placed you in fear of physical violence. The purpose is to require him or her to stay away from your home, your car, your place of employment, and other places the court finds necessary.

A Motion for Order to Show Cause asks the court for specific relief. The relief being requested can relate to many areas of family law. When a party files a Motion for Order to Show Cause, the court sets a hearing date for the parties to argue the matter before a family law judge.

This motion may be used to seek temporary injunctive relief ex parte in Florida state courts. A court can issue a temporary injunction at the outset of litigation to preserve the status quo while the parties litigate over whether the court should maintain, extend or modify a preliminary injunction.

This form may be used if you are a party to a previously entered injunction for protection against domestic, repeat, dating, or sexual violence, or stalking, and you want the court to modify the terms of the injunction. If you use this form, you are called the moving party.

To dissolve a restraining order in Florida, the respondent must prove that the circumstances that granted the injunction no longer exist. If the court considers that the petitioner is no longer in danger, the injunction could be removed. Dissolving a restraining order is up to the judge's discretion.

The temporary injunction will take effect immediately after the respondent is served with a copy of it. It lasts until a full hearing can be held or for a period of 15 days, whichever comes first.
