Form 568 is the Return of Income that many limited liability companies (LLC) are required to file in the state of California. LLCs classified as a disregarded entity or partnership are required to file Form 568 along with Form 3522 with the Franchise Tax Board of California.

Overview. If your LLC has one owner, you're a single member limited liability company (SMLLC). If you are married, you and your spouse are considered one owner and can elect to be treated as an SMLLC. We require an SMLLC to file Form 568 , even though they are considered a disregarded entity for tax purposes.

While a single member LLC does not file California Form 565, they must file California Form 568 which provides details about the LLC.

However, a single-member LLC has more obligations to the state of California than a sole proprietorship. For example, a single-member LLC must register with the Secretary of State, file biennial reports, maintain a registered agent, list a California business address, and pay the annual $800 Franchise Tax.

Form 568 must be filed by every LLC that is not taxable as a corporation if any of the following apply: The LLC is doing business in California. The LLC is organized in California. The LLC is organized in another state or foreign country, but registered with the California SOS.

What is Form 568? Most LLCs doing business in California must file Form CA Form 568 (Limited Liability Company Return of Income), Form FTB 3522 (LLC Tax Voucher), and pay an annual franchise tax of $800. These businesses are classified as a disregarded entity or Partnership.

Use Form 568 to: Determine the amount of the LLC fee (including a disregarded entity's fee) based on total California income. Report the LLC fee. Report the annual tax. Report and pay any nonconsenting nonresident members' tax.

Pursuant to California Corporation's Code §17050, every California LLC is required to have an LLC Operating Agreement. Next to the Articles of Organization, the LLC Operating Agreement is the most important document in the LLC.
