What is Latent Defects Insurance? Latent defects insurance (also commonly referred to as a structural warranty) is a form of insurance that primarily provides indemnity against the costs incurred in rectifying defects that manifest within the structure after practical completion.

When a latent defect is present, it means that the product lacks the quality promised in terms of the sales agreement. The consumer has the choice of a refund, replacement or repair of the goods in terms of section 56. This can also be regarded as an implied warranty.

For the defect to be so covered, it must meet four conditions: it must (i) exist at the time of the sale, (ii) be unknown to the buyer, (iii) be serious and result in a deficit of use, meaning the property is unfit for what a reasonable buyer would have expected to use it for, and (iv) be latent.

Premier Guarantee. A latent defect is a fault in a property that could not have reasonably been discovered through inspection before completion, and ultimately sale. This could be due to the design, workmanship or materials used during construction.

Latent defects can include any issues that are not uncovered during a property inspection. At residential properties or other areas where you spend a significant amount of your time, common latent defects can include: Mold, water damage or leaks. Insect infestations, including termites.

Typically there will be a period of 12 years from completion of the construction (or sections thereof) within which latent defects need to be identified, responsibility determined and appropriate resolution actions agreed between the SPV, the Design & Build Contractor and possibly the Hard FM provider.
