An Occupier Consent Form waives certain rights of a resident of a property in favour of the mortgage lender. This form is also known as a Deed of Consent, Deed of Postponement and Consent to Mortgage or an Occupiers Waiver form.

1. The lender proposes to make an advance to the borrower in return for the borrower giving the lender a mortgage over the property.

An occupier, or occupant, is a person/persons or organisation who lives in or uses property and/or land, either legally as the owner or tenant, or illegally as a squatter. ... Tenants and licensees are considered the occupiers of the property in which they live, work or operate a business.

If an adult who is not a part-legal owner of your property is living at your house your mortgage lender will require them to sign an 'Occupier's Consent form'. An occupier can obtain a legal interest in a property even though they are not a registered owner of it.

Who can witness this? The witness needs to be 18 or over, not a relative, not party to this mortgage and doesn't live in the property. Dependent on who your new lender is, a mortgage advisor may not be an acceptable witness.

OCCUPIERS DEED OF CONSENT (ENGLAND AND WALES) The Lender proposes to make (in stages if applicable) a loan, and/or such further advances as the Lender decides, to the Borrower, secured by a legal mortgage over the Property.
