Notice of intention to defend. After service of the summons, the defendant has ten court (business) days in which to serve a formal confirmation of its intention to defend the action on the claimant's lawyers. Slightly longer time periods are permitted where summons is served outside of the jurisdiction of the court.

Time between being charged and the first hearing: 34 days. Time between the first hearing and completion at the magistrates': 9 days. Time between the sending of the case to Crown Court to the start of trial: 119 days. Time between the start of the trial and the completion of the trial: 50 days.

Generally speaking, matters that are less serious and less complex are tried in the Magistrates court and there you can typically expect a case to wrap up within two months. In the Crown Court, however, there is much less certainty and it is hard to pinpoint exactly how long your case might take.

If the defendant is in custody at the arraignment, the trial must start within 30 days of arraignment or plea, whichever is later. If the defendant is not in custody at the arraignment, the trial must start within 45 days of arraignment or plea, whichever is later.

One of the downsides to being charged via a summons is that it can arrive weeks or even months after your police interview. Receiving a court summons is never a nice surprise.

Section 19 of the Magistrates' Courts Act 1980 (MCA 1980) sets out the procedure to be followed by a magistrates' court in deciding whether a case involving an offence triable either way, to which the defendant has not indicated a guilty plea, should be tried summarily or on indictment.

The formality of address in any court room in South Africa has always amazed me. In the Magistrates Courts, the magistrates are addressed as “Your Worship”. In the high courts, male judges are addressed as “My Lord”, and female judges are addressed as “My Lady”.

Well you can, pretty much whenever you feel like it as most court hearings are open to the public. This is both civil and criminal hearings. Make sure though, that you do not attempt to make any recordings or take any photos.
