For “service by mail”: The server mails the papers to the party being served. If the party being served is a person, the papers can be mailed to his or her home or mailing address. If it is a business, the papers must be mailed to the owner(s) at the business's main office.

Proof of Electronic Service (POS-050) Tells the court that legal papers were electronically delivered to (served on) the other party. Lists the papers that were served and tells who they were served on, where and when they were served, and who served them.

The person who serves the defendant must sign a court paper showing when the defendant was served. This paper is called a proof of service (form SC-104). It must be returned to the court clerk as soon as the defendant has been served. You can download Form SC-104 here.

The court may electronically serve the notice on any party that has consented to receive electronic service. Any party may serve and file an opposition within 10 days after notice is mailed, electronically served, or such later time as the court may specify.

Effective June 1, 2022, regardless of when a case was initiated, attorneys and the public will be able to file documents electronically in Family Law case actions for divorce, legal separation, annulment, parentage, child custody, visitation, support (child and spousal), and family related issues.

Per the California Code of Civil Procedure section 1010.6, when a document may be served by mail, express mail, overnight delivery, or fax transmission, the document may be served electronically. This means that Electronic Service (E-Service) can be used for any case as long as all parties provide express consent.
