If you have a permanent home here, and spent more than 183 days in New Jersey, you are considered a full-year resident. NJ tax law calls this a “statutory resident.” If you're considered a statutory resident, you will be taxed on all of your income even if it's from sources out of state.

If you begin your office, position, or employment on September 1, 2011, or later, you must live in New Jersey unless otherwise exempted. If you do not live in New Jersey, you have one year after the date you start your job to relocate your residence to New Jersey.

If you are moving to Jersey permanently or you intend to live here for 5 years or more you will be classed as resident and ordinarily resident for tax purposes from the date you arrive in the island.

One of the reasons they're having such a tough time is that New Jersey has a law that requires all government employees to live in the Garden State.

An eligible non-citizen is considered a state resident when he/she has resided in the state of New Jersey for at least 12 consecutive months after receiving permanent U.S. residency as verified by the Alien Registration Receipt Card or other criteria that meet eligible non-citizenship status.

Per the Department of Education, effective September 1, 2011 in ance with the “New Jersey First Act,” all employees of State and local government, including school districts must reside in the State of New Jersey unless exempted under the law.
