Less than 6 months = 30 days notice. 6 months to 3 years = 60 days notice. Over 3 years = 120 days notice. This only applies to properties subject to the Chicago RLTO.

If the tenancy is based on other terms greater than a week but less than a year, the landlord can evict upon 30 days' notice. In the case of an expired written year-to-year lease in Chicago/Evanston, the landlord must provide 60 days' notice. Landlords can also kick out an at-will tenant for cause.

On average, it would take anywhere between 3 weeks to 6 months for a complete eviction process. This does not include any appeals for reconsideration.

The landlord must give the tenant notice and go through the court process to get an Eviction Order. Then they must get the Sheriff to remove the tenant from the unit. The landlord cannot change the locks or remove the tenant's property until the Sheriff enforces the Eviction Order.

The Clerk of the Circuit Court of Cook County, Illinois charges a fee of $237.00 to file an eviction seeking possession and less than $15,000.00 in rent damages. The filing fee increases to $432.00 for eviction cases seeking possession and rent damages in excess of $15,000.00.
