Chapter 720 of the Florida Statutes, also known as the Homeowners' Association Act, is a chapter of law that governs certain types of homeowners' associations in the State of Florida.

The role of an HOA board president is to represent the HOA board and their decision. Therefore, an HOA president can represent the board and their decisions, but they cannot make a decision on their own without consulting the rest of the board.

POAs stand in sharp contrast to an HOA or COA because of what they don't do. POAs do not own the common areas of a community, do not govern the community with rules and regulations, do not impose fees or fines and are not directly responsible for the upkeep and maintenance of the community.

Filing an Official Complaint Residents may file a Condominium/Cooperative Complaint Form (PDF) directly with the Division of Florida Condominiums, Timeshares and Mobile Homes. Hardcopies of the form can be obtained by calling 1.800. 226.9101 or 850.488. 1122.

In essence, the main difference between most HOAs and condo associations is the type of property they represent. Condominiums represent condos - apartments, while HOAs represent houses. Regardless of the association, they are both democratic institutions and therefore need to conduct elections.

Chapter 720 of the Florida Statutes empowers and controls the ability of HOAs to enforce their rules, whereas Chapter 718 of the Florida Statutes empowers and controls the ability of COAs to enforce their rules.

To request a Condominium/Cooperative Complaint Form (PDF), you may call 1.800. 226.9101 (from within Florida only) or 850.488. 1122, or download a printable copy from this page. Please complete the form, listing all of your allegations, and include any documentation or backup information that you may have.

—The purpose of this chapter is: (1) To give statutory recognition to the condominium form of ownership of real property. (2) To establish procedures for the creation, sale, and operation of condominiums. Every condominium created and existing in this state shall be subject to the provisions of this chapter.

Department of Business and Professional Regulation.

If you are looking for ways to contact your board, we recommend that you ask a neighbor or check your community website or social media. For new home buyers, consult with your realtor to obtain HOA contact info and governing documents.
