In overruling Roe and eliminating the federal constitutional right to abortion, Dobbs v. JWHO allows states throughout the United States to severely restrict or ban abortion outright. The Center for Reproductive Rights estimates that 26 out of the 50 U.S. states may, in fact do so.

The majority opinion, joined by five of the justices, held that abortion was not a protected right under the Constitution, overturning both Roe and Casey, and returned the decision regarding abortion regulations back to the states. As a result, Dobbs is considered a landmark decision of the Court.

The dissent noted that about a quarter of American women will have an abortion before age 45; the impact of overruling Roe and Casey will be most severe on poor women; and “the expectation of reproductive control . . .

Thomas Dobbs (the petitioner) was a Mississippi State Health officer. Dobbs filed a petition for certiorari, which was granted. The Supreme Court granted writ to address whether all pre-viability prohibitions on elective abortions are unconstitutional.

The outcome: The court held that there is no constitutional right to abortion and overruled the court's previous decisions in Roe v. Wade (1973) and Planned Parenthood of Southeastern Pa.
