Composite returns. The states that do not accept composite tax returns include Nebraska, Oklahoma, Tennessee and Utah (although Utah did issue a private letter ruling (02-033) in 2003 allowing a composite return for nonresident shareholders in an electing small business trust).

States that do allow composite returns include: Alabama, Connecticut, Delaware, Idaho, Wisconsin, South Carolina, Massachusetts, Michigan, North Dakota, New Hampshire, Tennessee, Texas, Nebraska, Oklahoma, Utah, Arizona, New York and Vermont, as well as the District of Columbia.

Composite tax returns shift the administrative burden of filing and paying state taxes for income earned by non-resident owners to the multi-state pass-through entity (“PTE”) versus the owner or investor. Basically, a composite tax return is a group filing by some or all of the non-resident members of the PTE.

Participation in a composite return will eliminate the need for an individual ultimate owner to file a Michigan Individual Income Tax Return (Form MI-1040), when the ultimate owner has no other Michigan-sourced income.

Oregon-source income Electing owners who have additional income from Oregon sources or who are doing business in Oregon may be required to file their own tax return in addition to participat- ing in the composite return. Personal income taxpayers may join multiple composite returns if they qualify.

A group nonresident tax return is a single tax return that is for a group of individuals, also known as a composite tax return, that meets the California individual income tax return filing requirement .

Additionally, if one elects to file a composite return, he forfeits certain deductions, exemptions, and credits that would have been allowed on a personal return. Another disadvantage is that losses can't be carried forward on composite returns, while they can on individual returns.

A Michigan Composite Individual Income Tax Return (Form 807) is a collective individual income tax filing for two or more participating nonresident members filed by the flow-through entity (FTE). This form is used to report and pay individual income tax under Part 1 of Public Act 281 of 1967, as amended.
