German Real Estate Transfer Tax (“RETT”) is a transaction tax which can for example be triggered due to acquisitions (share and asset deals), mergers, reorganizations, contributions, demergers, spin-offs, etc. involving German real estate owning com- panies.

The tax will be raised from 3.5% to 5.5%, representing a 57% increase. This new rate is expected to apply from January 01, 2023. The level of real estate transfer tax in Saxony has been among the lowest in Germany.

All parties involved in the real estate transfer agreement are generally liable for this tax, although the seller will normally insist on a clause which makes the buyer responsible for paying it.

German real property transfer tax is usually paid by the buyer. The tax rate varies form federal state to federal state. In Berlin the tax rate is 6 %.

The payment of the transfer tax can be negotiated between the Buyer and the Seller. Normally, in Southern California, the Seller pays. In Northern California, the Buyer pays.

In Germany, a direct transfer ("asset deal") of real estate located in Germany is subject to RETT. The tax rate depends on the individual federal state and varies between 3.5 and 6.5% of the purchase price. Under certain circumstances, RETT can also be realized upon a share deal.

If you plan to buy a home valued at less than €440.000, you do not need to pay the transfer tax of 2%. To qualify for the tax exemption, the first-time home buyer must: Age requirements: the buyer is of age (18) and under 35 years of age.

This Property Transfer tax is paid on the transfer of the property. The tax amount will vary depending in which region of Germany the property is purchased. It's between 3,5% and 6,5% of the purchase price.
