All employees must receive a meal break of at least 30 consecutive minutes if the employee is scheduled to work 7.5 or more hours per day. Meal breaks must be given sometime after the first two (2) hours of work and before the last (2) hours of work.

Delaware Law Requires Meal Breaks Meal breaks do not have to be paid. Some states require employers to give paid rest breaks, either in addition to or as an alternative to meal breaks. Delaware is not one of them, however. Delaware employers are required to provide only an unpaid meal break.

In Delaware, if an employee is dismissed, the company must pay the employee's last paycheck on the following normal payday or within 72 hours after termination, whichever is later. The last paycheck must contain all earned and unpaid salaries and any vacation or other benefits to which the employee is entitled.

In Delaware, overtime is compensated for any hours worked in excess of 40 hours in a work week. Delaware does not provide separate daily overtime rate per trade classification. Delaware prevailing wage law does not provide different wages for working on the weekend. Same overtime rules apply for working on the weekend.

The Department of Labor can collect minimum wages on behalf of Delaware workers. Effective January 1, 2022 Delaware's minimum hourly wage rate is $10.50. Delaware's minimum hourly wage will increase incrementally on January 1 of the next three years, to $11.75 in 2023, $13.25 in 2024, and $15.00 in 2025.

Wages must be paid at least once each month. Employees must be paid all wages within seven (7) days from the close of each pay period with some exceptions see Del Code Title 19, § 1102(d). If the payday falls on a non-workday, payment shall be made on the preceding workday.

Example B: The Electricians applicable prevailing wage rate is $45.00 including fringe benefits of $5.00 per hour.
